(And yes, I did attempt to contact them by email and phone before resorting to the more obnoxious behaviour of contacting the ISP. No reply to my email, and the series of friendly receptionists I got bounced between had no idea who would be responsible but promised me someone would call back. No joy there, either.)

I'd make sure the old link to download the software is dead (that the software was actually removed from their server). Otherwise the crankshafts may just send colleges a direct download link.

What are you on about? They took down the software as they were apparently required to. The fact that they left up the literature, well I'm not sure you can do anything about that as it was not created with GPL code. You might find some copyright infringements, but that's a different issue.

They complied with the take down notice. You're not happy so you're going to call sour grapes to it all. Grow Up. Sorry you're not happy with the win here.

I've had similar run-ins myself as well as seeing friends mistaken identified (the joy of IP addresses in large apartment complexes!).

The MPAA's legal ethics must have been written by the slimiest lawyers around. Lord knows the MPAA has shown time and time again they think they can get around the law simply because.

Every time crap like this happens, and it seems to be getting worse as time goes on, I'm impressed nobody has done anything terribly stupid.

awesome! I'm sure that the 'don't fuck with my shit' line is going to get you lots of heat, but it's a moot point. To be more precise, it's a red herring. Instead of arguing about the spirit of the GPL protected by modern copyright law (a point that another poster above missed), the draconian measures of the MPAA, the idea of strict liability as it applies to copyrights in general; there are those who will think that the CoC or Ubuntu is more important than the content of you post. I disagree. This OS, movement, company, etc. is about sharing information and humanity towards others. There is no similar idea in the MPAA's actions. I support your actions, your words, your stance and your distribution. Thank you.

You can't be sure that the MPAA owns the server, or they are renting the space there as part of their agreement with the ISP to host the site. Regardless, it doesn't matter. If an ISP gets a DCMA takedown notice, they have to inform the site's owner that they have 30 days (could be less), to remove the offending content, or the ISP is required to disconnect the server from the line until remedied.

I think you'll find "they" DID take down the content, not their ISP. Perhaps their content service provider, but an ISP deleting a hosted file doesn't edit web pages and remove links..

In actual fact, all they've done is taken down their content until such time as they can fully comply with the GPL requests. Some win. It'll be going back up again and then what?

It sounds like you were a little hasty in jumping from emails and phone calls to ISP take-down notices. Understand - when you make a complaint, a business has to do an investigation before they can act (like, removing a link). After their internal investigation discovered they were indeed in breach of GPL, they removed the link THEMSELVES.

In retrospect, your complaint to their ISP probably had absolutely nothing to do with it. You're banking on coincidental timing. Remmeber - the fact this was a GPL breach was reported long before you turned up on the scene.
